- In Belgium, invention patents can be protected for up to 20 years from the filing date. The annual fee should be paid each year starting from the 3rd year after the filing date. The payment of the renewal fees shall be due on the last day of the month containing the anniversary of the date of filing of the patent application. Renewal fees may not be validly paid more than 6 months before they fall due.
- If a renewal fee is not paid by its due date, the applicant or owner may still pay it within a 6-month grace period; a surcharge is applied — €85 for late payment of the 3rd - 10th annuity, and €230 for late payment of the 11th - 20th annuity.
