Ensuring Transparency and Protection of IP Information
In the realm of intellectual property, maintaining transparency and ease of access to information is crucial for success. The German Patent and Trademark Office (DPMA) provides a significant service in this regard: requests for file inspection and copies. Anyone can make a request in writing to the DPMA to obtain information in the following categories:
- Published patent applications
- Granted utility models
- Registered trademarks
- Authorized designs
For most documents related to patent and utility model procedures, the DPMA offers a convenient online inspection service through the DPMA Register. Here, users can access a substantial amount of data generated throughout the process of intellectual property applications and grants. It's important to note that accessing these documents still requires a written application.
However, DPMA has protective measures in place for certain content. Particularly, it safeguards information concerning the legitimate privacy of parties involved, such as personal details related to applicants' economic, financial, or health data, as well as petitions for reinstatement and legal aid applications. These categories are not subject to public inspection or copying. Moreover, any files containing information or imagery that clearly contravene public order or morality are also excluded from public scrutiny.
