How to delay publication for a Germany Design Application

Understanding and effectively utilizing international patent protection strategies is a crucial step in expanding into overseas markets. Companies can meticulously plan the patent application process and manage their finances to fully leverage the advantages of strategies like delayed publication, laying a solid foundation for long-term development.

Applicants can request a deferred publication of the design registration, for a maximum period of up to 30 months from the application date or priority date. If the applicant decides to extend the protection period to five years during the deferred publication period, the extension fee must be paid within the 30-month period.

Information Disclosed During Deferral: During the deferred publication period, only limited information will be published in the DPMA design register, including: 

  • Application number
  • Application date
  • Applicant's name

This option allows applicants to keep the design confidential while ensuring limited public disclosure for legal acknowledgment of the filing.
