EUIPO Design Corrections and Deficiencies
If there are deficiencies in the design patent application, the EUIPO's examiner will issue a rectification notice requiring a response within a specified period. Before formally issuing a rectification notice, the examiner may first provide an informal notice, known as a "preliminary examination report," to alert the applicant of potential issues. This aims to expedite the examination process.
Possible rectifications include:
- If the application claims one or more priorities that are not recorded in WIPO DAS
- If exhibition priority is claimed without submitting proof
The EUIPO examiner will notify the applicant to provide the missing copies of prior applications or exhibition certificates. The applicant must submit copies of the priority documents within 3 months from the filing date.
