- Annual fees are payable for the 2nd and each subsequent year following the date of grant of the patent.
- The fees must be paid 12 months before the date of expiration of the 2nd and each succeeding year during the term of the patent.
- Payment of annual fees may still be made within 6 months from the due date, subject to the payment of a surcharge of 100% concern.

- A Malaysian Utility Innovation is protected for a maximum of 20 years from the filing date.
- Renewal fees must be paid before the expiry of each term to maintain validity.
- If a renewal fee is not paid by the due date, the holder may still renew within a 6-month grace period, subject to payment of the renewal fee plus a surcharge equal to 100% of the outstanding fee. Failure to pay within the grace period results in lapse of the Utility Innovation right.

- In Malaysia, an industrial design is protected for an initial term of 5 years from the filing date and may be renewed for four further 5-year periods, reaching a maximum protection term of 25 years.
- Renewal fees must be paid every 5 years before the expiry of each protection period.
- If a renewal fee is not paid on time, a 6-month grace period is available, during which the right holder may still renew the design by paying both the renewal fee and a late surcharge of 200.00RM.
