  • In the United States, utility patents incur maintenance fees only after they are granted. These fees are paid in three stages aligned with the term of the patent: at 3 years and 6 months, 7 years and 6 months, and 11 years and 6 months after the grant.
  • Each payment window opens 6 months before the due date, and payments can still be made during a 6-month grace period following the due date, albeit with an additional surcharge.
  • If the fee is not paid by the end of the grace period, the patent will lapse. However, restoration of the patent is possible by filing a petition under "unintentional delay" and paying the required restoration fees.
  • Maintenance fees cannot be paid in advance for multiple periods; they must be paid within the designated payment windows.
