- In Spain, invention patents are protected for up to 20 years from the filing date. Annual fees are required starting from the third year after filing. The annual fees are due each year on the last day of the application month.
- If a renewal fee is not paid by the due date, the applicant or owner may still pay it within a 9-month grace period. No surcharge will be incurred for the 1st – 3rd months of grace period and there will have two further 3-month terms after the first 3 months ended. 25% of the annual fee will be incurred for the 4th – 6th months of the grace period and 50% surcharge for the 7th – 9th months.
